Droit de rétractation
1. General Information
In accordance with the provisions of Article L.221-18 of the French Consumer Code or its equivalent in the legislation of other European Union member states complying with Directive 2011/83/EU on consumer rights, the Client has a period of 14 days from the receipt of the ordered products to exercise their right of withdrawal without having to justify reasons or pay penalties.
It is specified for all intents and purposes that this right of withdrawal is not applicable to wines purchased en primeur (futures).
To exercise their right of withdrawal, the Client must notify Cavissima of their decision to withdraw by sending, before the expiry of the 14-day period:
- Either by mail or by email to contact@cavissima.com stating the Client's intention to exercise their right of withdrawal;
- Or by using the withdrawal form available at this address: Withdrawal from a distance purchase (on the internet, by mail order, teleshopping or telephone) | Entreprendre.Service-Public.fr
- Or by filling out the form at the bottom of this page
2. Effects of Withdrawal
In the event of withdrawal within the aforementioned period, Cavissima undertakes to reimburse the Client for all payments received, including delivery costs (with the exception of supplementary costs resulting from the choice of a type of delivery other than the least expensive type of standard delivery offered), within 30 days from the date on which the notification of withdrawal is received.
The reimbursement will be made using the same means of payment as used for the initial transaction, unless Cavissima and the Client expressly agree otherwise.
3. Return of Products
The Client shall send back the products in their original condition and packaging, unopened, undamaged (including due to inappropriate storage and/or return conditions for the product in question) or consumed, within 14 days following the notification of withdrawal. The return costs shall be borne by the Client.
Regarding Primeur wines (futures), the Client has a period of fifteen (15) clear days from the receipt of the deposit invoice to request the modification or cancellation of their order and its refund.
The withdrawal must be made by the Client by telephone or email following the instructions provided for this purpose in the Contact article.
It is hereby specified that the right of withdrawal cannot be exercised by the Client for:
- Products made to the Client's specifications or clearly personalized at their request;
- Products which have been unsealed after delivery and cannot be returned for reasons of hygiene or health protection;
- The supply of alcoholic beverages the delivery of which is deferred beyond 30 days and the value of which depends on fluctuations in the financial market (e.g., grands crus reserved before harvest).
